Zonder nu gelijk de formerende partijen tekort te willen doen: die zeven punten geven aanleiding tot zorgen.<br>\u00a0<br>Laat het duidelijk zijn dat spreken over de democratische rechtsstaat geen nutteloze exercitie is. Het recht is namelijk niet zwart-wit en de Grondwet en de daarin geborgde grondrechten zijn dat ook niet. Deze zijn aan interpretatie onderhevig. Juist in die interpretatie valt te zien hoe partijen zich echt verhouden tot de rechtsstaat. Jammer dan dat het rapport hier niet aan toe komt. Het blijft slechts bij een aantal staatsrechtelijke open deuren: \u201crechterlijke uitspraken worden nageleefd\u201d. Het zou wat zijn als ze daar anders over dachten!<br>De vraag is dan ook waarom de formerende partijen dit moesten \u2018overeenkomen\u2019 en al helemaal waarom dit zo lang heeft moeten duren. Het is een beetje alsof Feyenoord een Ajax aan het begin van de klassieker afspreken dat je de bal niet met je hand aan mag raken. Veel interessanter was het geweest als er werd gesproken over de interpretatie van rechten: wanneer is protesteren een gele kaart waard?<br><br>Ook andere passages in het eindverslag geven twijfels over het staatsrechtelijk niveau aan de formatietafel. Er wordt gesteld dat grondrechten een essenti\u00eble waarborg vormen voor de democratische rechtsstaat. Grondrechten zijn echter geen waarborg voor de democratische rechtsstaat, ze zijn essentieel onderdeel van de democratische rechtsstaat. Ze zijn geen middel om hem te begeleiden, maar een intrinsiek onderdeel ervan.<br><br>Daarnaast stellen de partijen dat uit de vrijheid van godsdienst voortvloeit dat ook kritiek op godsdienst geleverd mag worden. Dit vloeit echter voort uit de vrijheid van meningsuiting. Het mag klinken als juridisch muggenzifterij, maar het geeft wel aan hoe het met de staatsrechtelijke kennis gesteld is aan de formatietafel.<br><br>Verder spreekt het verslag veelal over de Grondwet, grondrechten en andere gecodificeerde regels (regels die letterlijk zijn opgeschreven). Het belang van algemene rechtsbeginselen wordt echter nauwelijks tot niet benoemd. Denk bij zulke algemene rechtsbeginselen aan de scheiding der machten, de redelijkheid en billijkheid en de algemene beginselen van behoorlijk bestuur. Dit zijn ook fundamentele onderdelen van de democratische rechtsstaat. Het zijn de spelregels waar de politiek zich aan dient te houden.<br><br>Tot slot willen de partijen onafhankelijke instituties beschermen en versterken. Hiervoor zeggen ze met concrete voorstellen te komen. Tegelijkertijd is het maar zeer de vraag wat de formerende partijen hiermee bedoelen, zeker in het licht van hun eigen uitspraken over diezelfde instituties. Denk hierbij aan de uitingen van Wilders over de rechtspraak, de NPO en de Tweede Kamer. Het is ongeloofwaardig om te denken dat dit wantrouwen in die instituties is verdwenen. Kortom: <em>the proof of the pudding is in the eating.<\/em><br><em>\u00a0<\/em><br>De conclusie over de basislijn maakt duidelijk dat er nog werk aan de rechtsstatelijke winkel is. Het is dan ook aan te raden aan een volgende informateur om nog eens goed naar die basislijn te kijken.
