Huwelijkse gevangenschap vindt plaats wanneer iemand tegen diens wil in vast zit in een religieus huwelijk. Senator Boris Dittrich sprak namens D66 zijn steun uit voor het wetsvoorstel. D66 vindt dat iedereen de vrijheid moet hebben om te kunnen scheiden, ook in het geval van een religieus huwelijk.\t<\/p>\t  <\/div>\n\t<\/div>\n  <\/div>\n\n\n<div\n  id=\"\"\n  class=\"wrapper Als een echtpaar voor de Nederlandse wet gescheiden is, betekent dit niet automatisch dat het paar ook religieus gescheiden is. Als een van de partijen niet mee wilt werken aan de be\u00ebindiging van het religieuze huwelijk of de regels van de religie accepteren de scheiding niet, dan kan iemand vast komen te zitten in een huwelijk. Soms kan een religieus huwelijk alleen met medewerking van de man worden be\u00ebindigd en wordt een Nederlandse echtscheiding niet zomaar erkend in een ander land. Als een vrouw dan een nieuwe relatie begint of opnieuw trouwt, kan zij in dat land worden geconfronteerd met sociale uitsluiting, stigmatisering, bedreiging, stalking en geweld. Ook loopt zij het risico te worden vervolgd voor overspel of bigamie. Senator Dittrich vroeg de minister of hij verwachtte dat deze wet invloed zal hebben op de positie van vrouwen. Volgens minister Weerwind zorgt deze wetswijziging ervoor dat vrouwen die gevangen zitten in een religieus huwelijk daar makkelijker uit kunnen treden. Zo vroeg hij de minister of en hoe de overheid kon garanderen dat echtgenoten meewerken aan be\u00ebindiging van het huwelijk, ook als die naar het buitenland gaan. Minister Weerwind gaf toe dat er grenzen zijn aan het recht: de verschillende dwangmiddelen, zoals een dwangsom of gijzeling, zullen niet altijd effectief zijn. Ook vroeg het Eerste Kamerlid hoe de mensen \u2013 vooral vrouwen \u2013 die gevangen zitten in een huwelijk, worden ge\u00efnformeerd over de gevolgen van deze wetswijziging. De minister benoemde de folders in verschillende talen, voorlichtingsbijeenkomsten, samenwerkingen met sleutelfiguren in (religieuze) gemeenschappen en ondersteuning aan organisaties als Femmes for Freedom.
