Het wetsvoorstel regelt de strafbaarstelling van agenten die de ambtsinstructie hebben overtreden. D66 heeft voor de wet gestemd, maar was kritisch op regels binnen de geweldsinstructie en op de wijze van afhandeling van klachten tegen de politie. Daarbij moeten ze soms in risicovolle situaties binnen een paar seconden beslissen of ze geweld zullen gebruiken. Wanneer de politie besluit om bijvoorbeeld bij een arrestatie geweld tegen burgers te gebruiken, dan is zij gebonden aan bepaalde regels. Dit is de zogenaamde \u2018Geweldsinstructie\u2019. \u00a0Hierin staat een opsomming aan regels rond het gebruik van het dienstwapen, de inzet van de politiehond, het stroomstootwapen, de wapenstok etc. D66 is kritisch en vindt een aantal regels te ruim, waardoor de politie onnodig veel geweld kan gebruiken. De huidige disciplinaire procedure is niet transparant. Het is belangrijk dat er een open cultuur komt bij de politie, waarin klachten en meldingen serieus worden opgepakt. Eerste Kamerlid Boris Dittrich heeft een motie ingediend om een vorm van tuchtrecht voor het optreden van individuele politieambtenaren in te voeren met inachtneming van beginselen van openbaarheid, onafhankelijkheid, specifieke deskundigheid, transparantie en waarin een formele rol voor de burger\/het slachtoffer is weggelegd. Geen enkele regel kan elk risico op een fout ten koste van de burger uitsluiten. Door regelgeving, opleiding, materieel en sterke controle, inclusief een adequate en transparante klachtenbehandeling, kunnen fouten echter wel worden ingedamd.<br><br>Tot slot is in de samenleving een discussie ontstaan over etnisch profileren door de politie. D66 is daar fel op tegen.
